These Terms of Service ("Terms") govern your use of the services provided by PolyMegMPA B.V. ("we," "us," or "our"), a company registered in the Netherlands with registration number B63202512 and VAT number NL41202568B3, located at Kastanjelaan 51, 3041 CN Rotterdam, South Holland, Netherlands.

Acceptance of Terms

By accessing our website at polymegmpa.top or using our luxury manicure and pedicure services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services or access our website.

Services Description

PolyMegMPA provides luxury manicure and pedicure services at our studio location in Rotterdam. Our services include but are not limited to classic manicures, gel manicures, luxury pedicures, spa pedicures, nail art, nail repair, and specialised nail treatments. All services are provided by trained professionals in accordance with industry standards and health regulations.

Appointment Booking and Cancellation

Appointments may be booked through our website, by phone, or in person. We require advance notice for appointment cancellations or rescheduling. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee. No-shows may be charged the full service fee and may affect future booking privileges.

Payment Terms

Payment for services is due at the time of service unless other arrangements have been made in advance. We accept cash, debit cards, and major credit cards. Prices are quoted in Euros and include applicable VAT. Prices are subject to change without notice, though any changes will not affect services already booked at the time of the price change.

Client Responsibilities

Clients are expected to arrive on time for appointments, provide accurate health information relevant to nail care services, follow pre and post-treatment care instructions, and treat our staff and facilities with respect. Clients must disclose any allergies, medical conditions, or medications that may affect nail care treatments.

Health and Safety

We maintain strict hygiene and safety standards in accordance with Dutch health regulations. All equipment is properly sterilised between clients. Clients with certain health conditions, infections, or allergies may not be suitable for certain treatments. We reserve the right to refuse service if we believe it would be unsafe or inappropriate.

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of PolyMegMPA or its licensors and is protected by Dutch and international copyright laws. You may not reproduce, distribute, modify, or create derivative works of our content without express written permission.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which complies with the General Data Protection Regulation (GDPR) and Dutch data protection laws. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the fullest extent permitted by Dutch law, PolyMegMPA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.

Service Warranties and Disclaimers

While we strive to provide high-quality services, we cannot guarantee specific results from our treatments. Individual results may vary based on personal factors. We provide our services "as is" and disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose, except as required by law.

Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including breach of these Terms. Upon termination, your right to use our services will cease immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Force Majeure

PolyMegMPA shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, elements of nature, acts of God, acts of war, terrorism, riots, civil disorders, rebellions, or other similar causes beyond our reasonable control.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Rotterdam, Netherlands.

Dispute Resolution

Before pursuing formal legal action, we encourage clients to contact us directly to resolve any disputes. We are committed to working with our clients to find mutually satisfactory solutions to any concerns or complaints about our services.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of our services after any such changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. The invalid or unenforceable provision will be replaced by a valid, enforceable provision that most closely matches the intent of the original provision.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and PolyMegMPA regarding the use of our services and supersede all prior and contemporaneous written or oral agreements between you and PolyMegMPA.
